The semi crossed the center line and hit a car and then a jeep. </p>
<p>Three people were killed and two others were injured. The injured woman was taken by ambulance to St. Vincent Healthcare in Billings and an infant was taken by help flight to St. Vincent. The infant has since been flown to Denver.</p>
<p>“Federal regulations require commercial truck drivers to use extra care when driving,” stated Attorney Fred Pritzker. “When innocent people are killed in a head-on collision with a commercial truck, the trucking company and the truck driver need to be held accountable.”</p>
<p>The Montana Highway Patrol do not suspect alcohol to be a factor in the crash. The accident continues to be investigated.</p>

A North Dakota Highway Patrol press release reported that a northbound 2011 Peterbilt semi truck failed to yield the right-of-way to a southbound 2005 Ford Expedition at U.S. Highway 85. </p>
<p>After the semi was struck by the Expedition, the semi truck was pushed into a GMC stopped at the stop sign waiting to go east. All three vehicles ended up in the middle of Hwy 85.</p>
<p>The driver of the Expedition and his two passengers, including his 6-year-old daughter, were injured and transported to Mercy Medical Center. The driver of the GMC was not injured, nor was the driver of the semi that failed to yield to the Expedition.</p>

			<content:encoded><![CDATA[<p>Navistar is recalling certain model year 2012 International Workstar commercial trucks. The trucks were manufactured from February 7, 2011 through June 7, 2011 and built with dual steering gear feature codes 05PRB, 05PTE, 05PUA, 05PUB, 05PUC, 05PUD, 05PUE or 05PUH. The fastener that attaches the Pitman arm to the right side steering gear may not have been tightened to its specified torque, or the associated locking feature may not have been properly installed. Either of these conditions could lead to a loose connection and possibly allow the Pitman arm to separate from the steering gear resulting in loss of steering control and increase the risk of a crash.</p>
<p>The recall affects 188 units and is expected to begin on or before August 19, 2011. At that time, dealers will inspect the Pitman arm / steering gear connection, and either the connecting fastener will be tightened to the correct assembly torque or the arm will be replace free of charge. <a href="http://www.safercar.gov/" target="_blank">Safercar.gov</a> has more information on this and other truck recalls. </p>

The bolts used to mount the steering gear were not tightened to specification. The bolts may loosen which may cause the steering gear to disconnect from its mounting bracket. If this were to occur, there would be a complete loss of steering and increase the risk of a crash. </p>
<p>Anticipated date for the recall to begin is on or before September 5, 2011. The recall affects 2,294 trucks and dealers will replace the bolts, which will then be tightened to the correct specification, at no charge. The fast idle control may be activated by the operator while the transmission is in gear.</p>
<p>If the fast idle control function were to be engaged with the transmission in gear, the vehicle could unexpectedly accelerate and override the parking brake. This would increase the risk of crash and damage to other vehicles and the risk of injury to pedestrians.</p>

The accident occurred in Fulton County at the intersection of Route 24 and Route 136. </p>
<p>According to the sheriff&#8217;s department, a Jeep, driven by Curtis Hammond, 65, was hit by a tractor trailer that failed to stop at the intersection. Hammond and his wife, Eileen Hammond, 62, both died in the crash. The truck driver was given a citation and the accident is still under investigation.</p>

<p>The Wyoming Highway Patrol reported that Antoine K. Dean, 48, of Evansville, Indiana, was passing the semi truck when the truck&#8217;s drive shaft broke away and broke through his windshield. Dean was taken to a Laramie hospital where he died from his injuries. A passenger, riding in the back seat, sustained minor injuries.</p>

<p>These are the seven behavioral analysis areas and safety improvement categories:
<ul>
<li> Unsafe Driving: Speeding, reckless driving, improper lane change, and inattention. (FMCSR Parts 392 and 397)</li>
<li> Fatigued Hours of Service: Exceeding HOS, maintaining an incomplete or inaccurate logbook, and operating a CMV while ill or fatigued. (FMCSR Parts 392 and 395)</li>
<li> Driver Fitness: Failure to have a valid commercial driver’s license (CDL) and being medically unqualified to operate a CMV. (FMCSR Parts 383 and 391)</li>
<li> Control Substance and Alcohol: Use or possession of controlled substances (illegal and prescription) or alcohol. (FMCSR Parts 382 and 392)</li>
<li> Vehicle Maintenance: Failure to make needed and required repairs to brakes, lights, etc. (FMCSR Parts 393 and 396)</li>
<li> Cargo-Related: Improper load securement, cargo retention and hazardous material handling. (FMCSR Parts 392, 393, 397 and HM Violations) </li>
<li> Crash Indicator: Histories or patterns of high crash involvement based on information from state-reported crashes, including frequency and severity.</li>
</ul>
<p>The system uses a motor carrier’s data from roadside inspections, including all safety-based violations, State-reported crashes and the Federal motor carrier census to quantify performance. The SMS data system is not a Safety Fitness Determination (SFD), is not a Safety Rating pursuant to 49 C.F.R. Part 385 nor does it represent FMCSA&#8217;s final determination regarding the accuracy of the data contained in the SMS. (SMS has replaced SafeStat in the new Operational Model.) </p>
<p>It is highly recommended by FMCSA that all motor carriers periodically review the SMS data system. When necessary, the accuracy of the SMS data should be verified through DataQs, an electronic data correcting system in which carriers can request a data review. The DataQ system is available online at http://dataqs.fmcsa.dot.gov/. </p>
